- Trademark search: carry out a phonetic or literal search in the data base of the Mexican Trademark Office to find out if there exists an identical or similar trademark already registered or pending registration for the same or similar goods or services. If there exists no identical or similar trademark for the same or similar goods or services:
- Pay filing fees (Fees are included in the Company Setup + Premium Option) and file trademark registration application (electronically or in paper). Our service includes the registration in one class (An additional fee of $200 USD per class applies for each additional class.)
- Once the application has been filed, the Trademark Office will undertake a first review to make sure the formal requirements (payment of filing fee, application form is complete and signed, etc.) are met.
- If the Trademark Office is satisfied that the formal requirements have been met, the application will be published in the Industrial Property Rights Gazette.
- Anyone is entitled to file an opposition to the trademark registration within one month from the date of publication.
- If no opposition is filed and once one month has passed since publication, the Trademark Office will undertake a more thorough review to determine if there is an impediment to the registration of the trademark (for example, if a similar trademark is already registered for similar goods or services, or if a trademark is offensive or descriptive, etc.).
- If the Trademark Office concludes that there exists no impediment to the registration of the trademark, the trademark will be registered. The registration is published in the Industrial Property Rights Gazette. The registration certificate will be issued after the publication of the registration. If no opposition is filed, it takes approximately 4-8 months from the filing of the application until registration of the trademark.
- The registration is for 10 years from the date of filing of the trademark registration application. The registration can be renewed for additional 10-year terms.
- Within the three months following the third year of registration, the owner of the trademark must file a statement of use, otherwise the registration will expire.
